 Colleen Lynn has organized another group called Families & Dogs Against FightingBreeds 

She has called a meeting for;

 “An open meeting of Families and Dogs Against Fighting Breeds (FDAFB) will take place on February 12, 2008, in the meeting room at the Uptown Cafe from 6:45-8 pm.

Goals will be to introduce ourselves, talk about various volunteer roles and discuss the finalized legislation for a Seattle Citizen’s Initiative regarding fighting breeds.”

She says that it is an open meeting, so all of you Seattle dog owners be sure to attend. Since the name of the group includes “dogs” we wonder just how many dogs are members of her little group. Will the dogs be welcome at the meeting?

Having been a recent target of the Dogsbite.org blog, I decided to do a bit of research to find out who, and what is the driving power behind this radical website. It is the brainchild of Kory Nelson, Assistant District Attorney Denver Colorado who feeds biased information to Ms. Colleen Lynn of Seattle, who is a graphic designer, and website builder. Apparently Kory Nelson researches the same news articles that I, too research.

Ms. Lynn was bitten by a dog while jogging in June 2007.

I found a whole lot more background when researching Ms. Lynn, she is quite the self promoter, and far from being unable to work at her chosen profession, she is now the mouthpiece for “Kill ’em All” Kory Nelson. Her business Vain Notion lists her clientele, and it is available to anyone running a search engine.

It is a tragic fact that Ms. Lynn was bitten severely while jogging. It is another fact that her bite originated from one dog, not everyone’s dog. One wonders if Ms. Lynn understands that breed specific dog laws do not prevent dog bites?

Great Britain passed nationwide BSL in 1989. The dog bite statistics remained the same. That is indicative that dog bites have nothing to do with dog breeds, but rather with negligent owners.

Responsible Dog Owners of the Western States recognizes that neither “Dangerous” Dog Laws, or Breed Specific Dog Laws protect the public. That is why RDOWS Model Dog Owner Regulations were developed. RDOWS Model Dog Owner Regulations are applied to the human factor in the human/dog equation. Of the two, only the human being has the capacity to understand, and to function to law. Only human beings have rights, and are expected to respond accordingly to the attendant responsibilities that come with those rights.

When legislators focus their legislation on animal behaviors, and mete out punishments to animals, they have taken American juris prudence back to the dark ages. Laws must be written for human beings. We look to the Constitution of the United States as being the foremost authority for laws in these United States. There isn’t one mention of animals, as our founding fathers knew then that animals were, and would always be the property, and thus the responsibility of their human owners. I will attach the letter that I sent to Kory Nelson, and cc’d to Colleen Lynn.

Having continued to research Colleen Lynn I’ve discovered some very interesting ommissions. The owner of the dog that allegedly bit Ms. Lynn has never been referenced in print. The dog was allegedly immediately euthanized, which is unorthodox, as most dogs that cause severe injury are held in quarantine, and then ethanized and the head sent for rabies testing. I have not yet been able to find a police report of the incident.  Ms. Lynn has not filed suit against the dog’s owner in Seattle, or King County.   Instead, Ms. Lynn would far prefer to cause harm to all of the dogs that were not involved in her alleged bite, and to all of the owners of those dogs.

Have you advised Ms. Lynn that breed specific dog ordinances set a legal precedent that allows the enacting body to add any, or all other breeds of dogs, and even all domestic species of animals?

Watch TRUTHS FROM RDOWS blog as I publicly expose your evil deeds once again. I have the courage of my convictions. I use my real name. You hide behind victims to plot against the ownership of animals, and you used your position to persuade Colleen Lynn to create her blog.

If Ms. Lynn is subpoenaed into Court, would she state that you initiated contact with her, and that you suggested that she use her computer skills to fight your war for you?

Shall we test the waters?

If Ms. Lynn were struck by a Ford truck, would you encourage her to work toward banning all Ford, Lincoln, and Mercury products? Of course not. How dare you put Ms. Lynn into such a precarious predicament, if not to appease your own ego driven obsession?

German filmmaker Fritz Kippler,  Goebbels’ most effective propagandists for the Nazi party, once said that two steps were necessary to promote a Big Lie so the majority of the people in a nation would believe it. The first was to reduce an issue to a simple black-and-white choice that “even the most feebleminded could understand.” The second was to repeat the oversimplification over and over. If these two steps were followed, people would always come to believe the Big Lie.

Today’s big lie in the United States concerns a mythical monster dog that was created by the Humane Society of the United States in order to line their pockets by stopping dog fighting. At the time dog fighting was legal in the late 1970’s. Dog fighting was dying out due to a lack of interest. It was legal, regulated and sanctioned until the HSUS worked so dilligently to have dog fighting made illegal.  Today dogfighting, being illegal,  is bigger, and bloodier than ever it was when legal. It is no longer governed by rules, and regulations nor is it operated under sanctions. The dogs are not revered as of old, they are simply fodder for the machine.

HSUS has a very good publicity department that feeds disinformation to the sensationalistic media. To one who takes notice,  in articles about “pit bulls” the term may appear more than two dozen times compared to articles about other dogs whose identification may only be mentioned once, if at all.

There is no such breed of dog that is recognized, or registered by any dog registry as “pit bull”.  Yet under the guise of banning this mythical monster there are nearly eighty breeds of dogs that are restricted, or prohibited from ownership in venues throughout the USA. There is something about the human psyche that loves a good monster story, and by using the steps that are named above they have been created whole cloth and aimed at untold ethnicities of people. We are as a nation geared toward dismissing these tactics when they are directed at our fellow human beings, except for a small minority of bigots. Yet we do not recognize them when they are directed through animals at the people who own them. The very people who would decry bigotry directed at their fellow humans are among the first to spout that same bigotry towards dogs, and their owners. They think nothing of parroting the “pit bull” myths.

Dogs are as individual within their respective breeds, as are we human beings within our ethnicity. It would be impossible for any one dog breeder to make the exact same dog time, after time. Yet we are supposed to believe that all breeders can replicate a monster at will? That is the big lie. Dr. Frankenstein was only able to create one monster in the fable by Mary Shelley, and it killed him. If the big lie concerning “pit bulls” were true, wouldn’t the U.S. government snatch up these “monster” breeders to teach them how to make military dogs? In the myth, only very stupid, drug dealing, knuckle dragging dregs would own “pit bulls”, yet they are also brilliant geneticists who can at will create these “monsters” of mythical proportion that no other dog breeders are capable of creating.  

Legislators pass laws that are based upon myth instead of addressing the problem of irresponsible dog owners. Banning mythical beasties will not make our communities safer. Responsible Dog Owners has devised a set of Model Dog Owner Regulations that address the dog owner rather than the dog. It is available upon request.  Our laws in the United States of America must be written to control human behaviors. When our lawmakers attempt to define animal behaviors, and to criminalize those behaviors, they have lost touch with the very spirit of the law. No animal will ever be cognizant of any law that has ever been, or will ever be written, nor will an animal ever have the capacity to function responsibly to any law.

Many people accept without question, or proof that there is a pet-overpopulation crises in the United States. They cite the numbers of animals that are killed in shelters as their proof. That “proof” will increase dramatically in shelters across the county that took in animals that were “rescued” from the areas hit by the Hurricanes Katrina, and Rita. These animals will considerably add to the shelter’s kill numbers, and will lead to legislation to quell the crisis. In order to “prove” pet overpopulation, animal rights groups, and shelters are importing animals from China, Haiti, Romania, Taiwan, South America, and from countries around the world, and shuttling them across this nation. With those animals go their diseases that are not endemic to the United States of America. Shelters all over this country were shut down in the past year to get control of disease epidemics. Animal transports are at an unprecedented level. These transported animals are being used to inflate local shelter’s intake and euthanasia rates. If there were truly a pet overpopulation in the United States of America, wouldn’t it  make a whole lot of sense not to import animals from elsewhere?

Over-population is caused by an environmental situation that affects the whole population, such as drought, or crop failure, or even war. It means that there are no life sustaining resources to keep the populace alive. Over-population affects every living thing within the confines of the afflicted area. It would mean that there is no food, no potable water, no shelter, no medical supplies, no clothing, nothing to keep the entire population alive, and thriving. If we truly had a pet-overpopulation here in the USA, we wouldn’t just be talking about the sterile killing of animals for disposal in so-called shelters. We would be eating those animals to save ourselves from starvation.  If there was truly an overpopulation, there would be empty super-market shelves. No medical supplies, or services. Lines for potable water. We would all look like the people who have honestly suffered from the real situation of no sustaining resources available. We wouldn’t be a diet conscious nation, we would be in serious nutritional trouble. Over-population doesn’t play favorites. It affects the entire population of living beings.

Animal rights groups basically built the shelters, and told people that they didn’t have to be responsible for their animals anymore. Just dump them at the shelter. It’s become big business, and the shelters are not only thriving, but they are getting bigger, and better multi-million dollar facilities. Interestingly the Humane Society of the United States, one of the foremost purveyors of the pet overpopulation myth,  operates no shelters at all, and uses a large portion of it’s donations to make even more money. They recently have come under investigation by the Louisiana Attorney General for misuse of funds obtained after Hurricane Katrina, some $30,000.000.00. PeTA with all of it’s millions in revenue operates one shelter where it kills 83% of all the animals that it brings in.

We need to question what we are being told by these animal rights groups, and not be so quick to accept what they tell us as truths. Look at their real agenda. They post it on their websites. That agenda is to liberate all animals from our ownership, use, and care. No more pets. If we can’t own pets, there can’t be an “over-population”.  No more domesticated animals of any kind. 

Responsible Dog Owners of the Western States position on pet overpopulation is that it is a lie that is perpetrated by the animal rights movement, and fueled by the minority of pet owning society, the irresponsible, careless, negligent owner.

Enumclaw, Washington is one of  eighteen cities in Washington to have breed bans. Enumclaw specifically bans, and prohibits possession of Bull Terriers, Staffordshire Bull Terriers, American Staffordshire Terriers,  American Pit Bull Terriers, and any mixed breed of dog that contains as an element of its breeding any of the aforementioned breeds of dogs within their city limits. The city of Enumclaw abuts the King County Fairgrounds where several major dog shows are held. Persons attending the dog shows with the prohibited breeds are denied the use of services in the city of Enumclaw. One may not stay in a motel, buy gasoline, eat in a restaurant, or make purchases from a convenience store when they are in possession of any of the prohibited breeds of dogs.

 

Glen Bui, of the American Canine Foundation, and Cherie Graves, chairwoman of Responsible Dog Owners of the Western States are filing a lawsuit in the Western District Federal Court against the city of Enumclaw for violating their constitutional rights of travel, and commerce, and for discrimination. Neither are representing their respective organizations in this suit.

 

Glen Bui, and Cherie Graves spoke with attorney Peter Kram, of Tacoma who advised them that the case will cost approximately $50,000.00. Peter Kram is a judge-pro-tem, and is familiar with breed specific dog ordinances, and the harm that they do to innocent, responsible dog owners.

 

No other dog owners of the prohibited breeds were willing to join in the lawsuit. Both the American Canine Foundation, and Responsible Dog Owners of the Western States have offered help in funding the lawsuit, but neither organization has nearly enough funds to finance the entire cost of the suit.  RDOWS has less than $1,000.00 in its treasury after helping to get Responsible Owners of Arkansas Dogs, Inc., up and running.  We need help from the dog fancy. No donation is too small to help stamp out BSL.

Great cruelty always follows upon the heels of any sort of ban. A perfect example is the inhumane treatment of the confiscated dogs in Denver, Colorado. The mindset behind the cruelty is,  that the targeted breed/type of animal, or race/ethnicity of human being,  is considered unworthy of life, it becomes a target for debasement, torture, even starvation, and eventually death. It starts with individuals, and ends with genocide.   The target is no longer considered to be a member of it’s species, but an aberration that must be annihilated. Breed specific dog ordinances are today’s legalized hate crimes.

Breed specific ordinances utilise very same tactics are to be found in every instance of prejudice that lead to abominable hate crimes. This time the targets are dogs that have been so vilified that they are no longer considered to be dogs, but some sort of mythological beasts. Breeders are portrayed as evil Dr. Frankenstein-like genetic manipulators. How is it that only the breeders of the targeted breeds are capable of mass producing cookie cutter-like monsters?  That concept is incredibly absurd, yet it is promulgated throughout society, and  the media, it runs like a sewer through the thought patterns of otherwise intelligent people. Nobody ever questions the absurdity of the statements, or the belief system that foments breed specific legislation. 
 
Euthanasia is accepted way to dispose of unwanted animals in our shelter systems. When euthanasia is ordered by law to be performed upon dogs that are loved, and wanted by their rightful owners, and is performed with a mindset of hatred, bordering upon obsession it becomes a societal illness. Lucas County Ohio Dog Warden Tom Skeldon is an example of a person who has placed himself into a position that has allowed him to feed his overpowering need to annihilate all dogs that he determines are “pit bulls”.  His excuse is that it is his job. The truth is, that it is his obsession, and when he thought that his evil avarice was about to be curtailed, he went over the edge of sanity, and reason. Kory Nelson is the Adolph Eichmann of Denver dogs. His obsession has flowered like a contagion of hatred. He is spreading his vile disease of hatred across the continent.  If either of these twisted individuals did not have animals to act out their murderous tendencies upon  would they target human beings?  People do not just fall into their professions. People choose the professions that bring them satisfaction.  
 
Behind every dog is it’s owner. We all must become acutely aware that we are the true targets of this hatred. Society generally accepts that it is okay to target our dogs. It is strange, that those people who love their animals cannot conceive of the fact that we who own the targeted breeds love our dogs, too.  Why are people open to believing that our dogs are not as worthy as their dogs?  Why is it that people do not understand that we owners of the  banned breeds have the same deep intense feelings for our animals, as they have for their animals?  How is it in that our animals are unfeeling, unloving, ravening monsters, while their animals are loving pet?. We are being excised out of mainstream society by our elected officials based solely upon the breed of dog that we choose to own.

The dog owners in Denver, or Ohio, or any other place that has enacted a breed specific ordinance will tell you that their lives have been ripped apart. They have been violated beyond their wildest imagining. This ban is no less an assault on their lives, than would be a rape, the murder of a family member, the invasion, and vandalism of a home, a violent attack upon their person. These victims of breed bans feel as though they have lost all control over their lives. They certainly feel that they have been the victims of cruel, and unusual punishment.

How can it possibly be legal for government to assault it’s citizenry for owning a certain type of dog? Is there not enough crime that our legislators must create a whole new class of criminal, the dog owner? We cannot allow breed specific legislation to stand. Legislators who remove the rights of the citizenry should be recalled for violating the Constitutional rights of the citizenry. There is the argument that we do not have a Constitutional Right to own dogs. It does not hold up to scrutiny. All our laws are based upon English Common Law, and upon tradition. The Constitutions of the U.S., and of the fifty states do not enumerate all of our rights. It would be an impossibility.  The  IX. Amendment – Rule of construction of Constitution: The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.   The X. Amendment – Rights of the States under Constitution: The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.  The more government is allowed to take through the quiet acceptance of the people, the more it will take, until we are enslaved. The ownership of dogs is a right retained through tens of thousands of years of tradition.
 

It is important support the efforts of the Responsible Dog Owners of the Western States.  RDOWS helps to set up RDO groups in each state to effectively fight breed specific legislation, mandatory spay/neuter legislation, and any other laws that adversely affect responsible dog ownership. RDOWS was founded in Washington state October 15, 1989 following upon the heels of the American Dog Owners Associations loss in the Washington Supreme Court. The Chief Justice Keith Callow wrote the decision to uphold the breed specific ordinances in Yakima, Buckley, and et,al. Chief Justice Callow’s term of office was near, and he would be running again in the November 1989 election. RDOWS rallied dog owning voters across the state. Voter registration booths were set up at dog shows. RDOWS threw its support behind a young attorney named Charles Johnson. He owned a Rottweiler, and he only had a $1,000.00 war chest. Charles Johnson was the dark horse in the list of candidates for the Washington Supreme Court. Charles Johnson, and RDOWS only had one month to defeat the sitting Chief Justice of Washington’s Supreme Court. Election day dawned. At the close of the polls Charles Johnson was the clear winner. Shock waves ran through the state, and the media. The Wall Street Journal covered the story. They declared it a fluke that Charles Johnson won. It was not a fluke. He is still sitting on the Washington Supreme Court. Dog owners comprise approximately 65% of the population. We are a strong, but untapped voting block.  RDOWS has proven effective in combatting poorly concieved laws that have been introduced by overly zealous elected officials.

Our experience with dogs is that as long as a dog is trained, socialized, and given proper attention that the containment method is not a factor in it’s behavior, or temperament. Dog behavior only becomes problematic when a dog is not properly trained, not properly socialized, and not given proper attention. All dogs need to have some freedom within limitations. Constant kenneling, constant chaining, or constantly living on a cable run with no off time makes a dog highly protective, even obsessive of it’s territory. Responsible Dog Owners of the Western States believes that the individual dog owner is the best authority to choose from this list of approved methods of dog containment, with added specifications, for his/her dog(s). KENNELING; A kennel must be large enough for a dog to comfortably have a house, move room, a place to eliminate body waste, a concrete slab floor, or patio block floor over sand to prevent digging escape, and for ease of cleaning. It must have an escape proof roof cover with protection from the elements. Shade must be provided for at all times. A rubber mat, or a horse stall mat prevents pressure sores. The dog should be taken out of the kennel several times a day for training, play, and/or attention. STEEL CABLE RUN; A ½ inch diameter steel cable is run tautly between two in-ground mounts that are made of bent rebar sunk in concrete twelve feet apart, and two feet deep, leaving a six inch high loop of rebar above ground level. The cable is secured with cable fasteners. The dog’s chain is attached to the steel cable by a large steel O-ring, of a strength that cannot be broken by the dog. The chain should be six feet long, and of a strength that the dog cannot break. The collar should be made of leather, not chain, and of a strength and quality that it cannot be broken. The run area must be free from entanglement obstructions. The dog must have adequate housing to protect it from the elements, and shade must be provided at all times. The dog should have several off cable times each day for training, play and/or attention. A perimeter fence should be in place to prevent trespass by children, or animals not belonging to the dog owner. TETHERING; A strong center mount attachment may be employed to safely tether a dog. That mount may be made of a length of rebar bent into a hairpin shape, and sunk in cement two feet deep, leaving four inches of the bend above ground, or any other strong, escape-proof type mount, including an automobile axel. Attach a break-proof chain to the rebar with an O ring, or swivel snaffle of sufficient strength that it cannot be broken. The chain must be at a minimum four times the length of the dog. Use a strong leather collar of a quality that cannot be broken, not a chain around the dog’s neck. Remove any entanglement obstacles from the immediate area. Adequate shelter must be provided along the perimeter of the tether area to protect the dog comfortably from the elements. Shade must be available at all times of the day. The dog should have several off tether times each day for training, play and/or attention. A perimeter fence should be in place to prevent the trespass by children or animals not belonging to the dog owner. HOUSE DOGS; Dogs whose owners contain them to the house, or apartment must ensure that his/her dog receives adequate exercise to maintain a healthy cardio-vascular system. House dogs need time outside in the sunlight to absorb vitamin D. House dogs are prone to having toenail breakage, and they must have proper toenail care. Often house dogs become overweight from too much food, and lack of exercise. Going outside should be more than just a trip for elimination of bodily waste. House dogs need training, socialization, and play times, too. IN CONCLUSION; In today’s society dog containment is a must to protect not only the animal, but the neighbors, and their animals, as well as the dog owner him/herself from liability. RDOWS approves all of the above methods as long as the dog has adequate attention, exercise, care and nurture. All equipment must be regularly maintained to prevent injury, or escape of the dog. Each owner’s property will differ, so no one method works for all. The key to having a healthy happy dog is it’s all around care, and nurture. POSITION STATEMENT ON BREED SPECIFIC LEGISLATION

 Responsible Dog Owners of the Western States opposes breed specific legislation (BSL) on legal, and on moral grounds. Our position is that every dog owner is responsible for protecting the public from his/her dog. Our research shows that in the majority of severe or fatal dog attacks there had been numerous, previous reports made to Animal Control that were not acted upon. Our research further shows that as shocking, and traumatic as severe or fatal dog attacks are, they are relatively uncommon occurrences in comparison to other causes of severe injury, or fatalities in the United States, given that the vast majority of Americans are dog owners. MORALITY·        BSL is based upon the urban myth of the “pit bull”, which is not a recognized breed of dog. Under the guise of banning “pit bulls” any breed may be thus identified. There are at least seventy-five actual breeds, plus any mixed breed now either banned from ownership, or restricted in ownership in the United States. That is about 1/5 of all recognized breeds.·        BSL is inflammatory, and is based upon unproven beliefs, not facts.·        BSL is under inclusive in that it only recognizes a threat to society from certain  breeds, or mixed breeds of dogs. ·        BSL is over inclusive, as dogs are as varied within their breed, as are human beings within our ethnicity.·        BSL by stipulating, and naming specific breeds as being dangerous indemnifies all of the unnamed breeds as being safe by exclusion. ·        BSL creates a false sense of public safety.·        BSL does not address the irresponsible dog owner.·        BSL punishes the law abiding dog owner.·        BSL orders the death of dogs based solely upon their physical appearance.·        BSL assumes that human beings are inferior to, and incapable of properly maintaining dogs of specific breeds, or appearance. LEGALITY·        BSL has been ruled unconstitutional in Court venues across the United States on grounds ranging from vagueness, to an infringement of property rights, to equal treatment, equal protection.·        Dogs have been the domesticated traditional property of human beings for well over thirty-five thousand years. This tradition gives legal standing to dog owners based upon the IX Amendment of the Bill of Rights in the Constitution of the United States of America.·        BSL violates the rights granted under the IV Amendment to the Bill of Rights.·        BSL violates the rights granted under the V Amendment of the Bill of Rights.·        BSL violates the rights granted under VI Amendment to the Bill of Rights.·        BSL violates the rights granted under VIII  Amendment to the Bill of Rights.·        BSL violates the rights granted under XIV Amendment to the Bill of Rights.·        BSL creates a whole new criminal class, the dog owner.·        BSL sets a legal precedent that unchallenged empowers the enacting body to add any, or all other dog breeds, or even domestic species of animals to the prohibition on ownership.

1. Dogs are Personal Property

(a) The (city) (county) (state) of _____________ recognizes that dogs are personal property.

(b) No city, county or state authority shall restrict, or prohibit the ownership of dogs by breed.

(c) No breed specific ordinances enacted in _________ shall stand.

(d) The (city) (county) (state) of _____________ recognizes the right of the people to own any breed of dog in a responsible manner.

2. Containment

(a) All dogs shall be securely contained to their owners premises. The dog owner shall protect the public from his/her dogs. The assumption of liability is upon the dog owner.

(b) All dogs shall be securely leashed when off of the owners premises, and under the of a supervision of a person who is physically capable of controlling the dog.

(c) Parents who allow their child to lead a dog in public access areas, assume all liability for any accident, harm, or injury caused.

(d) Dog owners who allow a child to lead their dog in public access areas, assume all liability for any accident, harm, or injury caused.

(e) Owners walking their dog(s) in public areas are required to pick up, and properly dispose of stool waste deposited from their dog(s).

(f) Owners of dogs found at large by animal control authorities must produce documentation, upon demand, of the dog’s immunizations as required by the state.

3. Standard of care

(a) It is the responsibility of each dog owner to provide for their dog(s);
1.) Ownership for the entirety of the dog(s) life.
2.) Nutrition on a regular daily basis, and clean potable water readily available.
3.) Containment to the owners premesis
4.) Training
5.) Immunizations as required by state law, and veterinary medical treatment as necessary for maintenance of health

(b) If the owner cannot provide for the dog, it is the owner’s responsibility to;
1.) Find the dog a new owner.
2.) Pay for euthanasia by a licensed veterinarian.
3.) Pay a local animal shelter to provide for the dog until a new owner can be found.

(c) Failure to meet any of the standards of care are violations, and shall be considered cruelty to animals.
1.) If found guilty the Court shall fine the owner, and/or order or jail time commensurate with the harm done to the animal.
2.) The Court may remove the animal from the custody of the owner.
3.) The Court shall cause the property of dog owners who have been found guilty, to be posted with warning signs that are clearly visible on all perimeters that state, “IRRESPONSIBLE ANIMAL OWNER”.
4.) The signs may be removed after five years with no violations.

4. Noise Nuisance
 

(a) It is the responsibility of the owner to prevent his/her dog from causing a noise nuisance by barking. Incessant barking indicates lack of care.
1.) Owners may be ticketed for noise nusiance, and fined.
2.) This section does not apply to dogs barking to alert their owners.
5. Dogs At Large

(a) Any owner who allows his/ her dog to run at large shall be fined one hundred dollars ($100.00) for the first violation

(b) The second violation shall incur a fine of two hundred dollars ($200.00)

(c) The third violation shall incur a fine of four hundred dollars ($400.00)

(d) The fourth violation by the owner shall cause the dog to be confiscated by the Animal Control Authorities and, after evaluation of temperament by qualified personnel, either placed into a responsible home, or humanely euthanized.

(e) Nothing in this section shall pertain to owners hunting with dogs.
6. Owner Liability

(a) A dog owner will be charged with negligence for any property damage, or harm, or injury done by his/her dog when the dog was at large, off of the owners premises, and out of the owners immediate control. If the dog’s owner is found guilty in a Court of law, then he/she shall be held liable. This liability shall include remuneration, fines, and/or jail time, at the Court’s disgression, and depending upon the severity of the damage, harm, or injury done by the dog.

(b) A dog owner shall be charged with negligent homicide, whose dog kills a person when at large, off the owners premises, and out of the immediate control of the owner. The dog shall be confiscated by the authorities, and humanely euthanized, and tested for rabies at the cost to the owner.

(c) A dog owner shall be charged with reckless endangerment, whose dog injures a person, or causes an accident while at large, off the owners premises, or out of the immediate control of the owner. The dog shall be removed from the owners custody, and be evaluated on temperament by qualified personnel, and either be placed in a responsible home, or humanely euthanized.

(d) A dog owner shall be charged with aggravated nuisance, and animal cruelty if he/she is found facing off dogs in any public area with the purpose of simulating a dog fight, or promoting a dog fight, or planning a dog fight, and fined five hundred dollars ($500.00). The dog owner shall be placed on strict probation for the period of one (1) year during which time if any violations occur, the dog owner shall be fined one thousand ($1000.00), and he/she shall lose custody of the dog. The dog shall be evaluated by qualified personnel, and either be placed in a responsible home, or be humanely euthanized.

(e) A dog owner shall be charged with aggravated nuisance should his/her dog menace a person when at large. The owner shall be fined five hundred dollars ($500.00) and placed on probation for six months, during which time if any violations occur he/she shall lose custody of the dog. The dog shall be evaluated by qualified personnel, and either be placed in a responsible home, or humanely euthanized. 

f) A dog owner shall pay remuneration, and fines, if found guilty of negligence in a Court of law,  when his/her dog being at large, and out of the owner’s control,  trespasses upon another’s property, and injures, or kills an animal, or animals belonging to that person(s) whose animal(s) were contained to their property.  The dog owner shall be placed on strict probation for the period of one(1) year, during which time should any further violations occur, the dog shall be removed from the custody of the owner. The dog shall be evaluated by qualified personnel, and either placed into a responsible home, or humanely euthanized.

(g) Any dog owner, by whose violations has caused his/her dog to be removed from his/her custody, shall not be allowed by the Court to own another dog for a period of ten (10) years.

(h) No dog owner will be held liable if the dog bites, injures, or kills an intruder, a burglar, a trespasser, or anyone who threatens the owner, or his/her safety while on, or off of the owner’s premises while the dog is under control of the owner.

(i) Any person who is bitten as a result of teasing, or tormenting a dog that is contained to it’s owners premises, or who is bitten while teasing, or tormenting a dog that is contained to the owner’s premises shall have no legal recourse for damages.

(j) Any parent whose child is bitten, or mauled by a dog, due to the parent’s inattendance to his/her child shall be charged with reckless endangerment of a child.

(k) Any parent whose child dies as a result of a dog mauling, due to the parents inattendance, shall be charged with negligent homicide.

7. Dog Abandonment

(a) Any person who is found guilty of abandoning a dog, or dogs by dumping it/them alongside any thoroughfare, or by moving away and leaving the the dog, or dogs shall be subject to a one thousand dollar fine ($1,000.00)per dog, and three months jail time, or a one thousand dollar ($1,000.00) per dog fine, and community service not to exceed six months, per dog abandoned, at the discretion of the Court.

8. False Reporting

(a) Any person who makes a false, or malicious report to Animal Control shall be charged with a gross misdemeanor.
